General Conditions for Participation – Testing Phase for the Development of Autonomous MOIAs („Testing Phase T&Cs“)
A. General Information
You are participating in the testing phase for the development of autonomous MOIAs ("Testing Phase") as part of the autonomous MOIA mobility service project in collaboration with Volkswagen ADMT Hannover GmbH (ADMT) and Volkswagen AG (VWAG). The aim of this test phase is to evaluate automated vehicles ("Vehicles") and new features of the MOIA mobility service, including the interfaces with the vehicle. The vehicles are provided by Volkswagen ADMT Hannover GmbH and are approved under a special trial permit issued by Volkswagen AG.
This is a test operation with limited functionality designed to gain insights for developing an autonomous production vehicle. The vehicles are prototypes with specific usage requirements. A specially trained safety driver ("Safety Driver") will always be present in each vehicle, ready to intervene and take control if necessary.
Transportation within the testing phase is free of charge and conducted solely for development purposes. You will not incur any costs through participation or use. To ensure the continued development of the vehicles and service, we ask you to answer a few questions about your test ride after each trip. Booking another ride within the testing phase will only be possible after completing these questions.
In addition, the following applies:
A.1. The existing General Terms and Conditions of the MOIA mobility service and the MOIA Code of Conduct apply within the testing phase unless these Testing Phase T&Cs specify otherwise. Violations will result in exclusion from the test phase. MOIA reserves the right to take further legal action.
A.2. The service provider and contractual partner for the use of vehicles in the testing phase is MOIA GmbH.
A.3. Participation in the testing phase is by invitation only. Use of the vehicles without such an invitation is not permitted.
A.4. The instructions of the Safety Driver must be followed at all times.
A.5. Participation in the test phase is only permitted from the age of 18. Persons under 18 are neither allowed to participate nor to accompany participants.
A.6. Booking rides for third parties is not allowed.
A.7. Due to the prototype status of the vehicles, participation by individuals with disabilities is currently only possible after a case-by-case review and depending on the type and degree of disability. Participants must ensure that they can use the vehicle safely and enter and exit the vehicle independently in any situation. For safety reasons, individuals with pacemakers are not permitted to enter or ride in the vehicle. We regret that the service cannot yet be fully barrier-free.
A.8. The test phase aims to test the vehicles and the subsequent technical and organizational processes that enable the operation of a ride-pooling fleet. This includes constant interior monitoring via cameras for participant safety.
A.9. After each ride, participants are required to answer a series of questions about the test phase via the app. Only after answering these questions another ride can be booked.
A.10. As this is a test operation, unexpected disruptions such as delays or cancellations may occur. These might result in the ride not being conducted or only partially conducted. We will always keep you informed about any problems and delays. However, unlike in the regular service contract, there is no entitlement to actual transportation to the destination.
A.11. The participation of MOIA employees or other employees within the Volkswagen Group in test rides as part of the testing phase does not constitute a monetary benefit. Rather, it is an integral part of a product test and serves the operational interests of MOIA, ADMT, and VWAG. Completing the feedback form for the test phase at the end of the ride is not to be understood as compensation for the transportation but as a necessary measure to meet the regulatory requirements for the trial approval of the vehicle testing operations. This approach ensures that the testing process complies with legal regulations and aims to evaluate and further develop our technologies.
B. Behavioral Rules in the Vehicle
B.1. To ensure the safety and integrity of the testing operation, all participants must adhere to the following rules.
B.2. Sudden and unexpected driving maneuvers, such as abrupt braking or sharp turns, may occur. Therefore, seat belts must be fastened upon entering the vehicle and remain fastened throughout the trip.
B.3. Recording of any kind (photo, video, audio, or streaming) inside the vehicle is not permitted.
B.4. The transport of luggage and suitcases is not permitted. Only small personal items that can be safely carried on your own body are permitted. Dangerous objects are prohibited.
B.5. The SOS emergency stop button should only be used in emergencies. Misuse may result in sanctions, including exclusion from the testing phase.
B.6. Instructions from the Safety Driver and operators must always be followed.
Any behavior that could impair driving safety is prohibited, including unnecessary interaction with the Safety Driver during the ride unless required for safety reasons.
In particular, the following is required:
- Getting in and out of the vehicle carefully;
- Fastening the seat belt while driving.
C. Disclaimer
C.1. Participation in the test phase is voluntary and at the participant's own risk.
C.2. MOIA GmbH assumes no liability for damages directly or indirectly arising from the use of the vehicles, except in cases of gross negligence or intent on the part of MOIA GmbH. This does not exclude liability for damages resulting from injury to life, body, or health, or from the violation of essential contractual obligations. Essential contractual obligations are those primary obligations whose breach inherently endangers the purpose of the contract and upon whose fulfillment the contractual partner may rely.
C.3. In cases of simple negligence, MOIA's liability is limited to foreseeable and contractually typical damages.
