MOIA MOVE Raffle

Conditions of participation

In order to participate in the raffle, you must be registered for the MOIA MOVE program at the time of the draw on 11/15/2022 with the email address that we used to contact you to enter the raffle, have active consent for personalized marketing via the email channel and answer the raffle question correctly. In addition, you must enter your personal data correctly via the entry link attached to the email and agree to the data processing. Whether you are one of the lucky winners and can look forward to 2 tickets for an exclusive MOIA event on 12/01/2022, you will be informed by email by 11/21/2022 at the latest. Please be sure to enter a valid email address in the entry link so that we can contact you if you win. 

The conditions of participation tell you what happens after you win and what else you have to look out for when taking part: 

1. GENERAL 
MOIA GmbH, Alexanderufer 5, 10117 Berlin (hereinafter "MOIA") is the organizer of this raffle. By participating in this raffle, the participant agrees to the conditions of participation. Participation in the raffle is free of charge. The chances of winning are not increased by the purchase of MOIA services. 

2. CAMPAIGN PERIOD 
The raffle begins on 11/03/22 and ends on 11/14/22 at 11:59 PM (hereinafter "Promotion Period"). MOIA reserves the right to extend or shorten the Promotion Period in its sole discretion.  

3. ELIGIBILITY 
Persons who are at least 18 years of age at the time of participation, have unlimited legal capacity, and are resident or have permanent residence in Germany may participate in this raffle. The chosen accompanying person in the event of a win must also be at least 18 years old. Not eligible to participate are: 

  • the legal representatives or employees of MOIA,  

  • the legal representatives and/or employees of companies/corporations that are dependent on and/or affiliated with MOIA, 

  • Persons who - in particular via agencies and other service companies - are involved in the organization and/or implementation of the raffle, as well as   

  • Relatives (e.g., siblings, parents, children), fiancés, spouses, registered domestic partners, adoptive parents, adoptive children, foster parents, foster children of the foregoing.  

4. ENTRY FEE 
The participation in the raffle takes place via the participation link and the attached form, which must be filled out completely with the personal data (first and last name as well as email address) and sent via the "Send" button.  

5. EXCLUSION FROM PARTICIPATION 
MOIA reserves the right to exclude the participant from the raffle or to subsequently refuse the prize if he/she has violated the conditions of participation or has otherwise attempted to manipulate or influence the participation process and/or the raffle as such. MOIA is authorized, in particular, to exclude the participant from the raffle or subsequently to refuse the prize if one of the following reasons exists: 

  • There is no entitlement to participate according to section 3. 

  • Participation is in violation of the rights of third parties (such as name, copyright, trademark rights). 

  • Participation takes place with false personal data or use of other people's data. 

  • There is multiple participation via different email addresses.  

  • The participant disturbs or impairs the raffle.  

6. DETERMINATION AND NOTIFICATION OF THE WINNER(S) 
Winners will be selected at random from all eligible entries received during the Promotion Period. The winners will be informed no later than 11/21/2022. MOIA will notify the winners by email to the address provided in the entry form. 

The participant agrees that MOIA may send him/her personal messages by email in the event of winning.  

If the winner does not respond within 72 hours after the announcement, the claim to the prize will be forfeited and a new winner will be selected at random.  

If a prize is undeliverable due to the provision of incomplete or inaccurate data of the winner or due to non-collection, the claim to the prize shall be forfeited without compensation. 

7. WINNING/S, WINNING MEDICATION 
The following prizes can be won: 25 x 2 tickets to an exclusive MOIA event on 12/01/2022. 

If the advertised prize is no longer available, MOIA may award a prize of equal or greater value instead. The prize is not transferable or exchangeable. Cash payment is not possible. 

As soon as the winners by email back-registered and obligatorily confirmed, they receive in each case a place for itself and depending upon desire for an accompanying person on the guest list for an exclusive MOIA event on December 1, 2022. The entrance takes place at 6:30 pm over the entrance of the MOIA office Stadthausbrücke 8 in 20355 Hamburg. To be matched with the guest list, the full name must be given and the prize confirmation email must be shown. 

8. LIMITATION OF LIABILITY FOR THE CONDUCT OF THE RAFFLE 
MOIA's liability shall be governed by the statutory provisions, unless otherwise provided in these Terms and Conditions of Participation. 

MOIA shall be liable for damages, irrespective of the legal grounds, in the event of intent and gross negligence. In the event of simple negligence, MOIA shall only be liable for damages arising from injury to life, limb or health and in the event of a breach of a material contractual obligation (i.e. an obligation the fulfillment of which is a prerequisite for the proper performance of the raffle and on the observance of which the contractual partner regularly relies and may rely); in the latter case, however, MOIA's liability shall be limited to compensation for the foreseeable, typically occurring damage. 

To the extent that MOIA's liability is excluded or limited in this agreement, this shall also apply to the personal liability for damages of MOIA's employees, representatives and vicarious agents. 

9. CHANGES TO THE RAFFLE 
MOIA points out that the raffle may be terminated or changed due to external circumstances and constraints, without this giving rise to any claims by the participant against MOIA. This may be the case in particular if the proper execution of the raffle can no longer be guaranteed, for example in the event of technical problems or for legal reasons. 

10. FINAL PROVISIONS 
These terms and conditions of participation, including the raffle mechanics, constitute the final regulations for the raffle. 

The law of the Federal Republic of Germany shall apply to the exclusion of the conflict of laws provisions or the UN Convention on Contracts for the International Sale of Goods. With respect to consumers (i.e. natural persons who conclude a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity), sentence 1 shall apply only to the extent that the choice of law does not undermine the protection of mandatory legal provisions of the state in which the consumer has his habitual residence.  

With regard to the implementation of the raffle and the prize draw, the legal process is excluded.  

MOIA is neither obligated to participate in dispute resolution proceedings before a consumer arbitration board in the sense of § 36 VSBG nor does MIOA participate voluntarily.
